RAPID CITY, S.D. (AP) - The Pannington County Sheriff's Office says a Martin man is in custody after allegedly shooting another man during a roadside argument Wednesday night on Hwy 44 about 20 miles east of Rapid City near Farmingdale.

28-year old Francis Marshall is charged with 2 counts of aggravated assault and being a felony in possession of a firearm in the wounding of a 40-year old Martin man. He's also charged with driving under the influence.

The Sheriff's Office says the incident began when Marshall, the victim, and a third man were driving from Martin to Rapid City and ran out of gas about 11:00 pm.

They began arguing and Marshall allegedly shot the 40-year old, who suffered life-threatening injuries. His name has not been released.
