CHEYENNE, Wyo. (AP) - A state judge says the Wyoming Environmental Quality Council lacks authority to reject a permit for a proposed coal mine.
Laramie County District Judge Catherine Rogers ruled Friday that the Council improperly rejected Ramaco Carbon's permit application in 2017.
The company wants the mine near Sheridan to provide coal to research ways to turn coal into other carbon-based products, but the council rejected the permit request amid concerns about subsidence and groundwater problems.
Rogers ruled the council is limited to making recommendations to the director of the Dept of Environmental Quality, who decides whether to issue mine permits.
Department officials say they're reviewing the ruling while Ramaco attorney Tom Sansonetti told Wyoming Public Radio the DEQ now must consider either the original application or a revised one the company submitted after the council's original rejection.
