(Neb)-Chadron Jury Finds Rushville Man Not Guilty On 1 Count, Deadlocks On Another
CHADRON - A Dawes County District Court jury last week found a Sheridan County man Not Guilty of felony 3rd-Degree Assault , but was unable to reach a verdict on an accompanying felony charge of 1st-Degree Assault.
Keith Coomes of Rushville was accused of attacking a man in Chadron last summer. Prosecutor Joe Stecher says he won't decide whether to retry Coomes on the 1st-Degree Assault charge until a status hearing scheduled for October 22nd.
A second defendant in the case, Jered Kearns of Chadron, accepted a plea bargain shortly before going to trial earlier this month. Kearns will be sentenced November 12th after pleading No Contest to felony Attempted 1st-Degree Assault.
Also scheduled for a status hearing on October 22nd is T-J Boyd, whose Sioux County trial for felony Child Abuse earlier this month ended in a mistrial because a prosecution witness mentioned an allegation of sexual abuse - an accusation that had not been charged.
Prosecutor and Assistant Attorney General Doug Warner says he will retry the case with the status hearing to help determine the date for the new trial.
