(Neb)-Revised Brewer Wind-Energy Eminent Domain Bill Passed
LINCOLN, Neb. (AP) - Nebraska lawmakers have passed a scaled-back version of Gordon Senator Tom Brewer's bill to make it harder to install wind-energy transmission lines on private property if landowners object. The original version was defeated, but the new version earned final approval 44-0.
The original bill would have barred Nebraska's public power districts and REAs from using eminent domain to aquire land to install transmission lines for use by privately developed wind-energy farms, which opponents said would have stifled wind energy development in Nebraska.
The version going to the governor allows eminent domain, but gives opponents a better opportunity to challenge such projects in court.
