(SD)-Prosecutors Won't Seek Death Penalty In Rapid City Killing

RAPID CITY, S.D. (AP) - South Dakota prosecutors say they will not seek the death penalty for two Rapid City teenagers accused of killing a 17-year-old in Rapid City in February.
 
     Instead, Cole Waters and Andre Martinez, both 19, would get life in prison without possibility of parole if they're found guilty of aiding and abetting the 1st-degree murder of Emmanuel Hinton of Box Elder, who was shot during a drug deal.
 
     Pennington County State's Attorney Mark Vargo told the Rapid City Journal that South Dakota's death penalty can be used only in "very specific situations" where aggravating factors outweigh any mitigating ones - which doesn't fit the facts of this case.
