(Wyo)-Judge Dismisses Murder Charge Because Of "Stand Your Ground" Law
CASPER, Wyo. (AP) - A Casper judge has dismissed a 1st-degree murder charge based on Wyoming's new "stand your ground" law, but wants prosecutors to appeal her ruling.
Prosecutors argued that Jason John lured Wesley Willow to his Casper home to shoot him and was not protected by the law - which took place about a month after the law had taken effect.
The defense argued that Willow had threatened John before coming to his home uninvited in August and that John was entitled to defend himself in his own home.
Natrona County Judge Catherine Wilking agreed with the defense and dismissed the charge against John on Friday, but urged prosecutors to appeal the case to let a higher court consider the law's implications. District Attorney Dan Itzen says he plans to do just that.
