(SD)-Martin Father And Son Sentenced To Life For Manslaughter
WINNER, S.D. (AP) - A father and son from Martin, S.D., were sentenced to life in prison Friday for killing a man in Martin in November 2016.
58-year old Daniel Ceplecha and his 24-year-old son Rangler had pleaded guilty in February to 1st-degree manslaughter in the shooting death of 33-year-old Moses Red Bear during an argument at the father's home with both Ceplecha's shooting Red Bear.
Both recanted their guilty pleas in June, claiming they were forced to enter the pleas by attorneys who were incompetent.
6th Circuit Judge Bobbi Rank questioned both father and son under oath in June on their motions to withdraw their pleas.
Father Daniel said he didn't feel his attorney followed through on background checks for criminal records on Red Bear and a witness while son Rangler made the same arguments as his father, but also objected to his attorney having forced him to take a competency examination.
After deliberating for about 3 hours, Judge Rank denied the motions from both men to withdraw their pleas and to be appointed new attorneys. She said records showed both defense attorneys had spent many hours on the case and had hired a private investigation to further check out the victim and witness.
Rank also pointed out that each of the Ceplecha's were asked at the time that their pleas were entered if they were satisfied with their attorneys, knew what they were pleading to, and were willlingly pleading guilty and had said to all questions.
